995112312Whereas, on February 1, 1988, Troy L. Webb was brought to trial and convicted in the Circuit Court of the City of Virginia Beach of rape, robbery, abduction with the intent to defile, and the use of a firearm in the commission of a felony; and
Whereas, on March 9, 1989, Troy L. Webb was sentenced to 47 years in prison; and
Whereas, Troy L. Webb remained in jail from the time of his arrest until July 1989, when he was transferred to the Department of Corrections; and
Whereas, for the period that he was in the custody of the Department of Corrections, Troy L. Webb was incarcerated in facilities so distant from his home that he saw no member of his family for a period of over five years; and
Whereas, new forensic DNA testing produced results proving that Troy L. Webb could not have been the person who committed the crimes for which he was convicted; and
Whereas, Governor George Allen granted Troy L. Webb an absolute pardon from all of the offenses for which he was convicted; and
Whereas, the pardon was endorsed by the Commonwealth’s Attorney for the City of Virginia Beach; and
Whereas, Troy L. Webb was wrongfully incarcerated from the time of his arrest in February 1988 until the time of his pardon on October 16, 1996, and as a result has suffered mental and emotional trauma, in addition to substantial lost wages; and
Whereas, Troy L. Webb has no other means to obtain reimbursement for his expenses except by the action of this body; now, therefore,
Be it enacted by the General Assembly of Virginia:
1. § 1. That there shall be paid for the relief of Troy L. Webb from the
State Insurance Reserve Trust Fund administered by the Division of Risk Management of the
Department of General Services, upon execution of a release of all claims he
may have against the Commonwealth or any agency, instrumentality, officer,
employee, or political subdivision in connection with the aforesaid occurrence,
(i) the sum of $150,000 to be paid to Troy L. Webb by check issued by the State
Treasurer on warrant of the Comptroller and (ii) an annuity for the primary
benefit of Troy L. Webb providing for equal monthly payments, for a period of
ten years commencing on or about the effective date of this act, in the
cumulative amount of [ $350,000 $225,000 ] . The Division of Risk Management
of the Department of General Services shall purchase the annuity at the lowest cost available from any A+ rated company,
including any A+ rated company from which the Lottery Department may purchase an
annuity.
