HB 2542 Interest on judgments or verdicts.

Introduced by: William C. Mims | all patrons    ...    notes | add to my profiles

SUMMARY:

Civil remedies; interest on judgments, etc. Provides that when a judgment is entered on a negotiable instrument, interest will accrue on the principal amount of the judgment at the rate specified in the instrument or, if the instrument does not specify a rate, at the judgment rate of interest. Currently, because the U.C.C. is silent, an award of interest on the principal amount at a rate different from the judgment rate is discretionary with the court. Prior to the revision of former Title 8.3 interest ran at the judgment rate, unless otherwise provided in the instrument.
