SUMMARY:

Civil remedies; arbitrary refusal of motor vehicle insurance claim. Increases from $1,000 to $2,500 the ceiling amount of any claim against a motor vehicle insurance policy or registered uninsured driver which, if denied or refused arbitrarily by the insurer, may result in the insurer being liable to the insured for double the amount of the claim, together with attorney's fees and expenses. For such claims, the arbitrary refusal or denial of which may result in the insurer being liable for the amount of the claim, plus double the judgment rate of interest, the floor amount is also increased to $2,500. The bill allows for a jury to make the determination of arbitrariness, and includes within the provisions addressing claims for up to $2,500 and any refusal or failure to negotiate or settle a third-party claim.
