WHEREAS, large volumes of motor oil and antifreeze are sold to the public by retailers who do not collect waste motor oil and antifreeze from the general public, and the number of retailers collecting such waste is declining; and

WHEREAS, an increasing number of automotive service related businesses are no longer collecting used motor oil and antifreeze from the general public other than from the businesses' customers; and

WHEREAS, businesses collecting used motor oil and antifreeze must now pay a fee for the collection of their waste motor oil and antifreeze by businesses recycling these products; and

WHEREAS, automotive service businesses and others collecting waste motor oil and antifreeze from the general public are receiving an increasing amount of such waste products that are contaminated with other wastes, resulting in the waste motor oil and antifreeze having to be handled as hazardous waste, significantly increasing the cost of handling, collection and recycling; and

WHEREAS, difficulty in locating drop-off points for the proper disposition of waste motor oil and antifreeze may lead to increased improper disposal of such waste, causing damage to the Commonwealth's land and water resources; and

WHEREAS, it is therefore in the Commonwealth's best interest to encourage the cost-effective and proper disposal and recycling of waste motor oil and antifreeze; now, therefore, be it

RESOLVED by the Senate, the House of Delegates concurring, That a joint subcommittee be established to study means for enhancing the collection and recycling of waste motor oil and waste antifreeze. The joint subcommittee shall be composed of eight members, which shall include five legislative members, two citizen members, and one ex officio member as follows: two members of the Senate, to be appointed by the Senate Committee on Privileges and Elections; three members of the House of Delegates, to be appointed by the Speaker of the House; two citizen members, one representing an organization of automotive repair businesses and who is himself engaged in an automotive service-related business that collects waste motor oil and antifreeze from the general public, to be appointed by the Senate Committee on Privileges and Elections, and one representing an environmental organization interested in the recycling of motor oil and antifreeze to protect the Commonwealth's land and water, to be appointed by the Speaker of the House; and the Director of the Department of Environmental Quality, or his designee, who shall serve ex officio, without voting privileges.

In conducting its study, the joint subcommittee shall consider and recommend: (i) programs to increase the number of collection sites for the public disposal of waste motor oil and waste antifreeze; (ii) programs to educate the public regarding proper disposal of waste motor oil and waste antifreeze; (iii) programs to increase the collection of waste motor oil and waste antifreeze by retailers selling high volumes of motor fuel and antifreeze; and (iv) programs to offset costs of businesses collecting waste motor oil and antifreeze from the general public when such waste is contaminated with other materials which result in the waste being considered hazardous waste.

The direct costs of this study shall not exceed $3,800.

The Division of Legislative Services shall provide staff support for the study.

The joint subcommittee shall complete its work in time to submit its findings and recommendations to the Governor and the 1998 Session of the General Assembly as provided in the procedures of the Division of Legislative Automated Systems for the processing of legislative documents.

Implementation of this resolution is subject to subsequent approval and certification by the Joint Rules Committee. The Committee may withhold expenditures or delay the period for the conduct of the study.
