Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 11-41.2:6 as follows:

§ 11-41.2:6. Design-build or construction management contracts for public bodies other than the Commonwealth authorized.

Notwithstanding the provisions of §§ 11-41.2:2 and 11-41.2:5 and any other provisions of law to the contrary, the New River Valley Regional Jail Authority may enter into a contract for the construction of a regional jail on a fixed price or not-to-exceed price design-build basis or construction management basis in accordance with procedures consistent with those described in this chapter for procurement of nonprofessional services through competitive negotiation. The New River Valley Regional Jail Authority may authorize payment to no more than three responsive bidders who are not awarded the design-build contract if it determines that such payment is necessary to promote competition. The New River Valley Regional Jail Authority shall not be required to award a design-build contract to the lowest bidder, but may consider price as one factor in evaluating the proposals received. The New River Valley Regional Jail Authority shall maintain adequate records to allow post-project evaluation by the Commonwealth.
