Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 40.1-68.1 as follows:

§ 40.1-68.1. Posting of notice.

The Department shall prepare and make available for distribution a poster that [ describes in substantial form recites in their entirety ] the rights of employees and employers under §§ 40.1-59 through 40.1-64, 40.1-66, and 40.1-69. All employers having four or more employees subject to these provisions [ shall and who are subject to a collective bargaining agreement may ] display this poster in a conspicuous location in the workplace. [ Notwithstanding any other provision of this article, the Department shall prepare and make available for distribution a poster that recites in its entirety the provisions of § 40.1-57.3 and all state and local governmental agencies shall display the same in a conspicuous location in the workplace. ]

[ Nothing herein shall be construed to require a state, county, municipal or like government officer, agent or governing body to recognize any labor union or other employee association as a bargaining agent of any public officer or employee, to collective bargaining or contract with any union or association or its agent with respect to any matter relating to them or employment or service.]

2. That the provisions of this act shall become effective on January 1, 1998.
