AMENDMENT IN THE NATURE OF A SUBSTITUTE

A BILL to amend and reenact § 1 of Chapter 546 of the 1983 Acts of Assembly; the second enactments of Chapter 731 and Chapter 761 of the 1988 Acts of Assembly; the fourth enactment of Chapter 656 of the 1991 Acts of Assembly; the fourth enactment of the 1992 Acts of Assembly as last amended by the sixth enactment of Chapter 841 of the 1995 Acts of Assembly; the ninth enactment of Chapter 841 of the 1995 Acts of Assembly and § 2 of Chapter 845 of the 1996 Acts of Assembly, all relating to bond authorizations previously approved by the General Assembly for certain projects.

Be it enacted by the General Assembly of Virginia:

1. That § 1 of Chapter 546 of the 1983 Acts of Assembly is amended and reenacted as follows:

§ 1. That pursuant to § 2.1-234.13 of the Code of Virginia, the General Assembly hereby approves any undertaking by the Virginia Public Building Authority to acquire, construct, improve, furnish, maintain and operate any or all of the projects listed below, and to exercise any and all powers granted to it by law in connection therewith, including its powers to lease such projects to the Commonwealth and to finance any such undertaking, but in amounts not to exceed the amount specified below for each project, except for amounts needed to fund bond issuance costs, reserve funds and other financing expenses and except as otherwise provided in § 2 herein:

2. That the second enactments of Chapters 731 and 761 of the 1988 Acts of Assembly are amended and reenacted as follows:

2. That pursuant to § 2.1-234.13 of the Code of Virginia, the General Assembly hereby authorizes the Virginia Public Building Authority to undertake a project consisting of the construction and furnishing of an office building to be located in the City of Richmond on the block bounded by Thirteenth, Fourteenth, Main and Franklin Streets for the State Corporation Commission in an amount not to exceed $23,000,000 17,695,381, and to exercise any and all powers granted to it by law in connection therewith, including the power to lease such project to the Commonwealth and to finance the cost thereof by the issuance of revenue bonds in a principal amount not to exceed $23,000,000 17,695,381, plus amounts needed to fund issuance costs, reserve funds and other financing expenses.

2. That pursuant to § 2.1-234.13 of the Code of Virginia, the General Assembly hereby authorizes the Virginia Public Building Authority to undertake a project consisting of the construction and furnishing of an office building to be located in the City of Richmond on the block bounded by Thirteenth, Fourteenth, Main and Franklin Streets for the State Corporation Commission in an amount not to exceed $23,000,000 17,695,381, and to exercise any and all powers granted to it by law in connection therewith, including the power to lease such project to the Commonwealth and to finance the cost thereof by the issuance of revenue bonds in a principal amount not to exceed $23,000,000 17,695,381 plus amounts needed to fund issuance costs, reserve funds and other financing expenses.

3. That the fourth enactment of Chapter 656 of the 1991 Acts of Assembly is amended and reenacted as follows:

That pursuant to § 2.1-234.13 of the Code of Virginia, the General Assembly hereby authorizes the Virginia Public Building Authority to undertake a project consisting of the acquisition of land, incidental design and preparation for the construction of a correctional facility or facilities, and to exercise any and all powers granted to it by law in connection therewith, including the power to lease such project to the Commonwealth and to finance the cost thereof by the issuance of revenue bonds not to exceed $2,000,000 822,000 plus amounts needed to fund issuance costs, reserve funds, and other financing expenses.

4. That the fourth enactment of Chapter 878 of the 1992 Acts of Assembly, as last amended by the sixth enactment of Chapter 841 of the 1995 Acts of Assembly, is amended and reenacted as follows:

That pursuant to § 2.1-234.13 of the Code of Virginia, the General Assembly hereby authorizes the Virginia Public Building Authority to undertake projects consisting of the construction, improvement and furnishing of four correctional facilities and the acquisition of appurtenant land as follows:

Of the amounts provided for the Deep Meadow Prototype Correctional Facility #5, not more than $4,029,500 shall be used to furnish the project. Of the amounts provided for the Bland Isolation/Segregation Building, not more than $124,500 shall be used to furnish the project. The Virginia Public Building Authority is also authorized to exercise any and all powers granted to it by law in connection therewith, including the power to lease such projects to the Commonwealth and to finance the cost thereof by the issuance of revenue bonds not to exceed the principal amount set forth plus amounts needed to fund issuance costs, reserve funds, and other financing expenses. The Authority is further authorized and directed to locate the Deep Meadow Prototype Correctional Facility on a site in Lunenburg County. The Authority is further authorized and directed to locate the Keen Mountain Prototype Facility #4 (Sussex II) on an existing state-owned site in Sussex County, and to exercise any and all powers granted to it by law in connection therewith. The Department of Corrections, acting as agent for the Authority, shall design, construct and equip the Facility within the limits of funds provided for herein. To the extent that funds have been expended for a Facility to be located on a site in Wise County, such expenditures shall be considered to be in furtherance of the Keen Mountain Prototype Facility #4 (Sussex II), and may be paid from the proceeds of bonds issued for the project.

B. The Authority is further authorized and directed to locate the Keen Mountain Prototype Facility #2 (Red Onion) on a site in Wise County and exercise any and all powers granted to it by law in connection therewith, provided said site shall be conveyed to the Commonwealth at no cost to the Commonwealth. The Department of Corrections, acting as an agent for the Authority, shall design, construct and equip the Facility within the limits of funds provided for herein.

C. Of the amounts provided for the Keen Mountain Prototype Correctional Facility #2, not more than $3,000,000 shall be used to furnish the project. Of the amounts provided for the Keen Mountain Prototype Correctional Facility #4, not more than $3,000,000 shall be used to furnish the project.

5. That the ninth enactment of Chapter 841 of the 1995 Acts of Assembly is amended and reenacted as follows:

9. That pursuant to § 2.1-234.13 of the Code of Virginia, the General Assembly hereby authorizes the Virginia Public Building Authority to undertake projects consisting of the construction, improvement and furnishing of correctional facilities and the acquisition of appurtenant land as follows:

Of the amounts provided for the seven work centers, not more than $3,910,000 shall be used to furnish the projects. The Virginia Public Building Authority is also authorized to exercise any and all powers granted to it by law in connection therewith, including the power to lease such projects to the Commonwealth and to finance the cost thereof by the issuance of revenue bonds not to exceed the principal amount set forth plus amounts needed to fund issuance costs, reserve funds, and other financing expenses. The Virginia Public Building Authority shall not be authorized to undertake an adult detention incarceration center project until the governing body of the county, city, or town wherein the project is to be located has adopted a resolution supporting the location of the project within the county, city, or town.

6. That § 2 of Chapter 845 of the 1996 Acts of Assembly is amended and reenacted as follows:

§ 2. The Treasury Board is hereby authorized, by and with the consent of the Governor, to sell and issue, subject to the provisions of Section 9 (c) of Article X of the Constitution of Virginia, at one time or from time to time, bonds of the Commonwealth, to be designated "Commonwealth of Virginia Higher Educational Institutions Bonds, Series ....." in an aggregate principal amount not exceeding $113,324,000 93,824,000, plus amounts needed to fund issuance costs, reserve funds and other financing expenses. The proceeds of such bonds, excluding amounts needed to fund issuance costs, reserve funds and other financing expenses, shall be used exclusively for the purpose of providing funds, with any other available funds, for paying all or a portion of the costs incurred or to be incurred for acquiring, constructing, renovating, enlarging, improving and equipping revenue-producing capital projects at institutions of higher learning of the Commonwealth as follows:
