Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 29.1-735.01 as follows:

§ 29.1-735.01. Personal flotation devices.

A. It shall be unlawful for the owner of or any person having control of a motorboat greater than twenty feet in length to permit a person under the age of twelve to be in the motorboat while the motorboat is underway if such minor is not wearing a personal flotation device approved by the United States Coast Guard.

B. A violation of any provision of this section shall constitute a Class 4 misdemeanor.
