Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 16.1-299.2 as follows:
§ 16.1-299.2. Youth gang reporting.
Within seventy-two hours after the arrest of a juvenile, when it is determined through admission or investigation that such juvenile is a member of a gang, the juvenile's name and other appropriate gang-related information required by the Department of State Police shall be entered into the Youth Gang File of the Virginia Crime Information Network (VCIN).
[ For purposes of this section, youth gang is defined as an ongoing organization, association, or group of three or more juveniles with a common interest and/or activity characterized by the commission of or involvement in a pattern of criminal conduct. ]
2. That the Department of State Police shall develop, prior to July 1, 1997, policies and procedures consistent with and necessary to implementing the requirements of this act.
