Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding in Article 1 of Chapter 13 of Title 22.1 a section numbered 22.1-212.2:2 as follows:

§ 22.1-212.2:2. Access of certain students to public school programs and activities.

No student who (i) attends a nonpublic school or (ii) receives home instruction in a program in compliance with § 22.1-254.1 and provides evidence of such compliance to the division superintendent and who is eligible to attend the public school in his attendance zone on a full-time basis shall be denied access to public school programs and activities supported in whole or in part by state education funds.
