AMENDMENT IN THE NATURE OF A SUBSTITUTE

A BILL for the relief of John N. Brophy.

Whereas, John N. Brophy's 1989 Oldsmobile was stolen in December 1995; and

Whereas, when the vehicle was stolen, Mr. Brophy reported the theft of the car to the Fairfax County Police Department; and

Whereas, Mr. Brophy suffered a stroke just after the vehicle was stolen; and

Whereas, due to his stroke, Mr. Brophy experienced memory loss from the time the vehicle was stolen in December 1995 until March 1996; and

Whereas, during the time Mr. Brophy was incapacitated and a patient at Western State Hospital, between December 1995 and March 1996, the Arlington County Police Department found his vehicle abandoned, impounded it, and sold it; and

Whereas, Fairfax County sent Mr. Brophy a personal property tax bill for the vehicle for the 1996 tax year; and

Whereas, Mr. Brophy has no other means to obtain relief except by action of this body; now, therefore,

Be it enacted by the General Assembly of Virginia:

1. § 1. That there is hereby appropriated from the general fund of the state treasury the sum of $4,850 for the relief of John H. Brophy. This sum shall be paid by check issued by the State Treasurer on warrant of the Comptroller to John H. Brophy, upon execution by him of a release of all claims he may have against the Commonwealth or any agency, instrumentality, officer, employee or political subdivision thereof, in connection with the aforesaid occurrence.

§2. That Arlington County shall reimburse the general fund of the state treasury in an amount equal to the sum appropriated pursuant to this act. Such amount shall be reimbursed from the distribution of net profits appropriated to Arlington County pursuant to § 4.1-117.
