Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 18.2-271.1:1 as follows:

§ 18.2-271.1:1. Unique license stickers for second or subsequent conviction for driving while intoxicated; penalty.

Upon the conviction of any person for a second or subsequent offense of § 18.2-266 (i), (ii), (iii) or (iv), or any ordinance of a county, city, or town similar to the provisions thereof, or provisions of subsection A of § 46.2-341.24, the person may be required by court order for (i) the one-year duration of the restricted permit, if one is issued pursuant to § 18.2-271.1 E, or (ii) for one year from the date of reinstatement of the person's driving privileges, to apply to the upper, right-hand corner of the license plates of the vehicle owned and primarily driven by the defendant, a unique sticker for the purpose of plainly and clearly identifying the vehicle as owned by a person of such status. The court in its order shall identify the vehicle to which the stickers are to be applied. If, during the sticker application period, the person acquires a different vehicle, such identifying stickers shall be applied to the new vehicle for the remainder of the sticker application period.

Any registered owner of such a vehicle who intentionally removes or otherwise eradicates the unique stickers from that vehicle, or permits them to be removed or eradicated, prior to expiration of the period set forth in the court order shall be guilty of a Class 1 misdemeanor and his license to drive shall be revoked for one year, which revocation shall not be subject to suspension.

The unique stickers described herein shall be designed and supplied by the Department of Motor Vehicles.
