Whereas, the Town of Clarksville and the Virginia Department of Corrections entered into a Memorandum of Agreement on March 29, 1993 ; and

Whereas, the Memorandum was amended, effective August 31, 1993; and

Whereas, the amended Memorandum states that the Department of Corrections may haul water to the Baskerville Correctional Unit and the Mecklenburg Correctional Facility from the Town's water line; and

Whereas, it further states that the Department of Corrections would pay the commercial rate for water as if the Department were an in-town customer; and

Whereas, the favorable in-town commercial rate was established for the Department based on the Department's representation that it would assist the Town in extending the water line to provide long-term service to the correctional facilities; and

Whereas, the Town sent an invoice to the Department on February 10, 1995, for the difference in rates for out-of -town customers and those for in-town customers over its period of service to the Department because of the Department's failure to move forward with assisting the Town in extending the waterline; and

Whereas, the Department refuses to make payment; and

Whereas, the Town of Clarksville has no other means to obtain relief except by action of this body; now, therefore,

Be it enacted by the General Assembly of Virginia:

1. § 1. That there is hereby allocated from the general fund appropriation to the Department of Corrections for the relief of the Town of Clarksville the amount of $13,509.71 to be paid by check issued by the State Treasurer on warrant of the Comptroller to the Town of Clarksville, upon a release by an authorized representative of the Town of all claims against the Commonwealth and its political subdivisions, agencies, instrumentalities, officers or employees in connection with or arising out of the aforesaid occurrence.
