An Act to amend and reenact § 1-13.7 of the Code of Virginia, relating to gender; discrimination; pregnancy.

Be it enacted by the General Assembly of Virginia:

1. That § 1-13.7 of the Code of Virginia is amended and reenacted as follows:

§ 1-13.7. Gender.

A word importing the masculine gender only may extend and be applied to females and to corporations as well as males.

The terms "because of sex or gender" or "on the basis of sex or gender" or terms of similar import, when used in reference to discrimination, shall be construed to include, but shall not be limited to, because of or on the basis of pregnancy, childbirth or related medical conditions. Women affected by pregnancy, childbirth or related medical conditions shall be treated the same for all purposes as persons not so affected but similar in their abilities or disabilities.

2. That the provisions of this act are declaratory of existing law but shall not create an additional cause of action.
