SUMMARY:

Certificates of public need. Reduces the scope of the certificate of public need (COPN) program by eliminating the requirement for obtaining a COPN for major medical equipment replacement if (i) the applicant agrees to conditions established by the Commissioner in compliance with Board regulations, requiring the applicant to provide a level of care at reduced costs for indigents or to accept patients requiring specialized care, or (ii) the Commissioner determines that a certificate has been previously issued for replacement of the specific equipment. This bill also increases the capital expenditure threshold amount that triggers the requirement for a COPN for any project not specifically covered from one to five million dollars; however capital expenditures between one and five million dollars must be registered with the Commissioner. The bill authorizes a minimum application fee of $1,000 and a maximum application fee of $20,000. Present law provides for a maximum fee of $10,000. Clarifying amendments reinforce that the COPN law applies to medical care facilities whether or not such entities are privately or publicly owned or operated and that the COPN law applies to any facilitiy licensed as a hospital.
