Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 65.2-306.1 as follows:
§ 65.2-306.1. Employer removal of safety equipment; employee may elect remedies.
Notwithstanding any other provision of this title, if an employer intentionally removes from any machinery or equipment any safety guard, safety device or safety warnings provided by the manufacturer thereof, any employee injured as a result of such removal may bring an action at law against such employer in lieu of claiming compensation under the provisions of this title.
