Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 15.1-539.1 as follows:

§ 15.1-539.1. Penalizing employee for service on board prohibited; penalty.

A board member shall not be discharged from employment, nor have any adverse personnel action taken against him, as a result of his absence from employment due to attendance at [ regular ] board meetings [ or functions ] , upon giving reasonable notice to his employer of such absence. Any employer violating the provisions of this section shall be guilty of a Class 4 misdemeanor.
