Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 15.1-539.1 as follows:

§ 15.1-539.1. Penalizing employee for service on board prohibited; penalty.

A board member shall not be discharged from employment, nor have any adverse personnel action taken against him, as a result of his absence from employment due to attendance at board meetings or functions, upon giving reasonable notice to his employer of such absence. Any employer violating the provisions of this section shall be guilty of a Class 4 misdemeanor.
