Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding in Title 11 a section numbered 11-41.2:2 as follows:

§ 11-41.2:2. Design-build or construction management contracts for public bodies having a county manager form of government authorized.

Notwithstanding any other provisions of law and consistent with the procedures described in this chapter for procurement of nonprofessional services through competitive negotiation, any county having a county manager form of government [ which has on its staff a licensed professional architect or engineer ] may enter into design-build or construction management contracts on a fixed price or not-to-exceed price basis. The governing body of such county may authorize payment to no more than three responsive offerors who are not awarded the design-build contract if such governing body determines that such payment is necessary to promote competition. Such governing body shall not be required to award a design-build contract to the lowest bidder, but may consider price as one factor in evaluating the proposals received. Such governing body shall maintain adequate records to allow post-project evaluation by the Commonwealth.
