1995 SESSION
LD4003112Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 19.2-324.1 as follows:
§ 19.2-324.1. Contemporaneous objection required for reversal on appeal; exceptions.
A ruling of a trial court shall not be considered a basis for reversal on appeal unless the objection was stated together with the grounds therefor at the time of the ruling, except where the record affirmatively shows that (i) the defendant was convicted of a crime of which, under the evidence, he could not properly be found guilty or (ii) the error is otherwise so clear, substantial and material that the failure to reverse would result in a miscarriage of justice.
