Be it enacted by the General Assembly of Virginia:

1. That § 30-28.5:1 of the Code of Virginia is amended and reenacted as follows:

§ 30-28.5:1. Reporting by lobbyists; penalties.

A. Each individual required to register as a lobbyist under § 30-28.2 shall file with the Secretary of the Commonwealth, on a separate form for each person for whom, or on whose behalf, he lobbies, a complete and detailed disclosure statement signed by the lobbyist and such person and sworn to before some officer authorized by law to take acknowledgments to deeds, showing:

1. All expenses, retainers and salaries, or amounts thereof, paid or incurred in connection with lobbying by each person, for or on behalf of whom, the lobbyist has acted and showing the matters and purposes for which such individual lobbied.

2. All expenses, retainers and salaries received by the lobbyist in connection with lobbying, and all expenses, retainers and salaries incurred or paid by the lobbyist in connection with lobbying. The disclosure statement shall be on a form provided by the Secretary of the Commonwealth which shall be substantially as provided in subsection B and which shall be accompanied by instructions provided by the Secretary.

C. Statements shall be filed by June July 1 for the preceding twelve-month period ending May 1.

Such statements shall be in the form prescribed by the Secretary of the Commonwealth and shall be open to public inspection and copying during the regular business hours of that office.

D. A person who signs the disclosure statement, knowing that it contains a material misstatement of fact, shall be guilty of a Class 5 felony.

E. For the purposes of this section and § 30-28.5:2, such statement shall be deemed to have been filed only when it is actually received in the office of the Secretary of the Commonwealth or has been mailed to the Secretary of the Commonwealth by registered, certified, or regular mail with the sender retaining sufficient proof of mailing, which may be a United States Postal Certificate of Mailing.
