Be it enacted by the General Assembly of Virginia:

1. That § 32.1-13.1 of the Code of Virginia is amended and reenacted as follows:

§ 32.1-13.1. Health policy responsibilities.

The Board shall direct the Department to inform the Board regarding health care policy and financing concerns through such studies as the Board may deem necessary and appropriate to be conducted with the advice of and in consultation with the Virginia Health Planning Board. The Board shall make recommendations concerning health care policy and funding to the Governor, the General Assembly, and the Secretary of Health and Human Resources. In its capacity as advisor to the Governor, the General Assembly, and the Secretary of Health and Human Resources, the Board shall develop and recommend a needs-based funding formula for the state-local cooperative budget for funding local and district health departments which takes into consideration such factors as the demography and economic well-being of the locality or localities and which is designed to be phased in over a ten-year period. In developing such needs-based funding formula, the Board shall examine the similar formula developed in 1988.
