Be it enacted by the General Assembly of Virginia:

1. That § 22.1-307 of the Code of Virginia is amended and reenacted as follows:

§ 22.1-307. Dismissal, etc., of teacher; grounds; determination of competency.

A. Teachers may be dismissed or placed on probation for incompetency, immorality, noncompliance with school laws and regulations, disability as shown by competent medical evidence, conviction of a felony or a crime of moral turpitude or other good and just cause. No teacher shall be dismissed or placed on probation solely on the basis of the teacher's refusal to submit to a polygraph examination requested by the school board.

B. Pursuant to the cooperatively developed procedure for evaluation required by § 22.1-253.13:7, each school board shall include in its policy manual provisions that promote the retention of the most highly qualified, competent teaching staff attainable for the education of students. These provisions shall define those qualities in teaching personnel, including continuing education and teaching performance evaluations, that may be considered in determinations of teacher competency and shall indicate any weight given to a particular quality or component.
