SUMMARY:

Proceedings against certain parents. Confirms the jurisdiction of the juvenile and domestic relations court in cases of parents who refuse to comply with the provisions of new § 22.1-276.01 relating to parental involvement and responsibility. This provision sets out in new § 16.1-241.2 the penalties the court may impose, if it finds that parent has willfully and unreasonably failed to comply with the requirements of new § 22.1-276.01, i.e., a $50 civil penalty for failing to return the required statement acknowledging the school board's standards of student conduct and the parent's responsibility to assist the school in disciplining the student and maintaining order; order the parent to meet review the school board's standards of student conduct and the parent's responsibility to assist the school in disciplining the student and maintaining order and to discuss improvement of the child's behavior and educational progress; and, if the court finds that the parent has willfully and unreasonably failed to accompany a suspended student to meet with school officials or if the student has been suspended a second time or expelled, the court may order the student or his parent to participate in programs or treatment, subject the student or his parent to conditions and limitations deemed appropriate for the supervision, care, and rehabilitation of the student or his parent. The court may also order the parent of a suspended or expelled student to pay a civil penalty not to exceed $500. The court will not be authorized to use contempt power to enforce any of these orders. The civil penalties will be enforceable in the juvenile and domestic relations court in which the student's school is located and paid into a special fund maintained by the local governing body to support programs or treatments designed to improve the behavior of students. If the civil penalties are not paid, the attorney for the appropriate county, city or town will collect the civil penalties.
