SUMMARY:

Petitions for state procurement of less toxic goods and products. Allows any person to petition the Department of General Services or other state agency to have a good or product that contains, emits, produces, or generates less of a toxic or hazardous substance included in the procurement process. The toxic or hazardous substances include chemicals listed under the federal SARA Title III or Superfund laws. The petitioner would have to submit documentation which establishes that the good or product is less toxic and meets the procurement specifications. If it meets both criteria, the less toxic product would be included in the agency's procurement process. The bill also requires all state agencies to review their procurement procedures and specifications to encourage the use of less toxic goods and products. Items defined as goods and products include cleaning materials, paints, solvents, adhesives, inks, pesticides, herbicides, and other items used or consumed by an agency in the performance of its statutory functions, but do not include fuels, food, beverages, furniture, tobacco, or containers. This bill parallels House Bill 1604 (1993), which established an identical procedure for goods and products with recycled content. This is a recommendation of the Joint Subcommittee Studying Pollution Prevention (SJR 207, 1993).
