HB 1061 Goat milk.

SUMMARY:

Goat milk. Provides an exemption from all regulations governing the production, processing and sale of grade "A" pasteurized milk for incidental sales of raw goat milk directly to consumers at the farm where the milk is produced. Incidental sales are the sales by the farm directly to the consumer, provided such sales are less than 100 gallons per month. To be eligible for the exemption, the farm cannot advertise the milk, and the herd must be certified as free of brucellosis and accredited as free of tuberculosis. Each container must be clearly labeled "Raw Goat Milk, not for resale," and identify the farm where the milk was produced. The label must contain a warning that the milk is not pasteurized and may contain organisms injurious to your health. Each consumer must be given a pamphlet describing the risks associated with consuming raw milk and including instructions on how to pasteurize milk. Producers of the milk must make quarterly reports to the Department of Agriculture and Consumer Services on the number of gallons of milk sold. The Department is required to develop by July 1, 1995, the form and manner of the label and to develop the pamphlet consumers must receive with each purchase. Violators of the bill's provisions may be assessed a civil penalty in an amount not to exceed $100. The bill's provisions expire on July 1, 1998.
