SUMMARY:

Railroads. Requires that railroad-constructed wagonways provided for owners of land abutting railroad tracks be (i) adequate to accommodate all sorts of vehicles used for agricultural or forestal purposes, (ii) constructed in accordance with specific minimum engineering standards, and (iii) maintained in good repair; increases railroads' payment to landowners for failure to construct or maintain wagonways from $5 per day to $100 per day; increases pay of commissioners appointed to determine the need to construct a wagonway from $2 per day to $50 per day; provides that certain wagonways in continuous use for 20 years are subject to prescriptive easements in favor of the abutting landowners; eliminates requirement that certain tracts of land to be connected by a wagonway be owned by the same person; authorizes courts to grant equitable relief when fences or cattle guards are not built when required; increases payments to appraisers of livestock killed or injured by trains from $1 to $50 and increases clerk's fee for filing the appraisal from 50¢ to $2.50; requires that the minimum appraised value of cattle killed by trains be 1 1/2 times their meat value; and provides that failure to report the killing or injury of cattle by a train within 72 hours constitutes larceny of the dead or injured animal.
