WHEREAS, the 1993 Session of the General Assembly passed House Joint Resolution 494 establishing a joint subcommittee to study numerous issues involved in the potential benefits and detriments of utilizing the private sector in meeting the solid waste management and recycling needs of local government; and
WHEREAS, House Joint Resolution 494 continued and expanded on the work undertaken by the committee established by House Joint Resolution 85 and passed by the 1992 Session of the General Assembly requesting the Department of Waste Management to appoint a subcommittee to study issues surrounding privatization of solid waste management; and
WHEREAS, the House Joint Resolution 494 joint subcommittee resolved many of the issues raised during the deliberations of the House Joint Resolution 85 committee and has developed a work sheet to assist local governments in determining the full cost of solid waste management; and
WHEREAS, the House Joint Resolution 494 joint subcommittee was diligent in its efforts, but due to time restraints and the number and complexity of issues to be examined, the joint subcommittee was unable to consider fully all matters within its charge; and
WHEREAS, because numerous additional issues were raised during the deliberations of the joint subcommittee which must be addressed in order to fulfill its charge, the joint subcommittee has agreed that another year of study is necessary; now, therefore, be it
RESOLVED by the House of Delegates, the Senate concurring, That the joint subcommittee studying the utilization of the private sector in assisting local governments in meeting their solid waste management and recycling needs be continued. The subcommittee's study shall include those issues contained in House Joint Resolution 494 passed by the 1993 Session of the General Assembly and shall additionally include an examination of (i) the establishment of a system to compensate private entities that are displaced when government assumes responsibility for waste management in an area served by the private entity, (ii) revision of the Virginia Water and Sewer Authorities Act to be more applicable to solid waste management and (iii) the benefits and detriments of governmental control over the flow of solid waste.
The current 15 members of the subcommittee shall continue to serve.
The Division of Legislative Services shall provide staff support to the subcommittee.
The subcommittee shall complete its work in time to submit its findings and recommendations to the Governor and the 1995 General Assembly as provided in the procedures of the Division of Legislative Automated Systems for the processing of legislative documents.
The direct costs of this study shall not exceed $6,200.
Implementation of this resolution is subject to the subsequent approval and certification by the Joint Rules Committee. The Committee may withhold expenditures or delay the period for the conduct of the study.
