Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 18.2-312.1 as follows:

§ 18.2-312.1. Purchase, possession, or transportation of flamethrower; penalty.

It is unlawful for any person to purchase, possess, or transport a flamethrower. A violation of this section is a Class 1 misdemeanor. For purposes of this section, "flamethrower" means any portable device specifically designed or intended to emit or propel a burning stream of combustible or flammable liquid a distance of at least 10 feet.
