16103576DBe it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 54.1-3408.001 as follows:
§ 54.1-3408.001. Limits on dispensing of certain drugs; penalty.
A. No practitioner of medicine, osteopathy, podiatry, or dentistry shall (i) dispense to a patient an amount of a controlled substance that exceeds the amount necessary for the patient's use in a 72-hour period or (ii) dispense a total amount of any controlled substance that exceeds 2,500 dosage units in any 30-day period.
B. A practitioner of medicine, osteopathy, podiatry, or dentistry who fails to comply with the requirements of subsection A shall be subject to a civil penalty not to exceed $5,000.
