Be it enacted by the General Assembly of Virginia:

1.  That the Code of Virginia is amended by adding in Title 22.1 a chapter numbered 13.2, consisting of sections numbered 22.1-253.14 through 22.1-253.17, as follows:

CHAPTER 13.2.
CITIZENS STANDARDS OF LEARNING REVIEW BOARD.

§ 22.1-253.14. The Citizens Standards of Learning Review Board; purpose.

The Citizens Standards of Learning Review Board (the Citizens Review Board) is established as an independent board in state government. The purpose of the Citizens Review Board is to independently review the Standards of Learning established by the Board of Education (i) as often as the Board of Education reviews the Standards of Learning pursuant to § 22.1-253.13:1 and (ii) as often as the Citizens Review Board determines that a review of one or more of the Standards of Learning is necessary.

§ 22.1-253.15. Membership; terms; quorum; meetings.

The Citizens Review Board shall have a total membership of 16 members that shall consist of 13 nonlegislative citizen members and three ex officio members. Nonlegislative citizen members shall be appointed as follows: seven members to be appointed by the Speaker of the House of Delegates upon consideration of two recommendations from each local school board, conveyed by the Board of Education; four members to be appointed by the Senate Committee on Rules upon consideration of two recommendations from each local school board, conveyed by the Board of Education; and two members to be appointed by the Governor upon consideration of two recommendations from each local school board, conveyed by the Board of Education, and subject to confirmation by the General Assembly. The Superintendent of Public Instruction or his designee shall serve ex officio without voting privileges. The Chairman of the Education Committee of the House of Delegates and the Chairman of the Education and Health Committee of the Senate shall serve ex officio with voting privileges. Nonlegislative citizen members of the Citizens Review Board shall be citizens of the Commonwealth.

Ex officio members of the Citizens Review Board shall serve terms coincident with their terms of office. Appointments to fill vacancies, other than by expiration of a term, shall be for the unexpired terms. Vacancies shall be filled in the same manner as the original appointments. All members may be reappointed.

After the initial staggering of terms, nonlegislative citizen members shall be appointed for a term of four years. No nonlegislative citizen member shall serve more than two consecutive four-year terms. The remainder of any term to which a member is appointed to fill a vacancy shall not constitute a term in determining the member's eligibility for reappointment.

The Citizens Review Board shall appoint the Chairman of the Education Committee of the House of Delegates and the Chairman of the Education and Health Committee of the Senate as chairman and vice-chairman of the Board. Thereafter, the Committee Chairmen shall rotate as chairman of the Board. A majority of the members shall constitute a quorum. The meetings of the Citizens Review Board shall be held at the call of the chairman or whenever the majority of the members so request.

§ 22.1-253.16. Powers and duties of the Citizens Review Board.

Before and during any review of the Standards of Learning by the Board of Education, the Citizens Review Board and the Board of Education shall have the following powers and duties:

1. The Board of Education shall provide each member of the Citizens Review Board with access, on the Board of Education's website, to view the current Standards of Learning and an area to enter comments and suggestions about amendments to language in the Standards of Learning.

2. The Citizens Review Board shall, upon the vote of a majority of the members, make a final recommendation on the Standards of Learning either to accept the Standards of Learning as they are currently written or to suggest amendments to the current language in the Standards of Learning. The Board of Education shall report the Citizens Review Board's final recommendation on the Board of Education's website.

3. The Board of Education shall consider the final recommendation of the Citizens Review Board in its own review process.

4. The Citizens Review Board shall submit an annual report to the Governor and the General Assembly for publication as a report document as provided in the procedures of the Division of Legislative Automated Systems for the processing of legislative documents and reports. The chairman shall submit to the Governor and the General Assembly an annual executive summary of the interim activity and work of the Citizens Review Board no later than the first day of each regular session of the General Assembly. The executive summary shall be submitted as a report document as provided in the procedures of the Division of Legislative Automated Systems for the processing of legislative documents and reports and shall be posted on the General Assembly's website.

§ 22.1-253.17. Staffing.

The Board of Education shall provide staff support to the Citizens Review Board. All agencies of the Commonwealth shall provide assistance to the Citizens Review Board, upon request.

2.  That the initial appointments of nonlegislative citizen members to the Citizens Review Board shall be staggered as follows: seven members for a term of two years appointed by the Speaker of the House of Delegates; four members for a term of three years appointed by the Senate Committee on Rules; and two members for a term of four years appointed by the Governor.
