A BILL to amend and reenact § 36-105.1 of the Code of Virginia, relating to the Uniform Statewide Building Code; authority of local building officials; penalty.

Be it enacted by the General Assembly of Virginia:

1.  That § 36-105.1 of the Code of Virginia is amended and reenacted as follows:

§ 36-105.1. Inspection and review of plans of buildings under construction; powers of local building officials for unlicensed contractors.

A. Inspections of buildings other than state-owned buildings under construction and the review and approval of building plans for these structures for enforcement of the Uniform Statewide Building Code shall be the sole responsibility of the appropriate local building inspectors.

B. Upon completion of such structures, responsibility for fire safety protection shall pass to the State Fire Marshal pursuant to the Statewide Fire Prevention Code in those localities which do not enforce the Statewide Fire Prevention Code (§ 27-94 et seq.).

C. In addition to the penalties provided for in § 54.1-111, the local governing body of a county, city, or town may, by ordinance, authorize its building official to issue a summons for unlicensed activity by any person required to be licensed by the Board for Contractors pursuant to Chapter 11 (§ 54.1-1100 et seq.) of Title 54.1.
