SENATE BILL NO. 1323 AMENDMENT IN THE NATURE OF A SUBSTITUTE (Proposed by the Senate Committee on Local Government on January 30, 2007) (Patron Prior to Substitute--Senator Cuccinelli) A BILL to  [ amend and reenact § 15.2-2281 of the Code of Virginia amend the Code of Virginia by adding a section numbered 15.2-852.1 ] , relating to jurisdiction of localities to zone; signs.

Be it enacted by the General Assembly of Virginia:

1.  That  [ § 15.2-2281 of the Code of Virginia is amended and reenacted the Code of Virginia is amended by adding a section numbered 15.2-852.1 ]  as follows:

§ 15.2- [ 2281 852.1 ] . Jurisdiction of localities.

 [ For the purpose of zoning, the governing body of a county shall have jurisdiction over all the unincorporated territory in the county, and the governing body of a municipality shall have jurisdiction over the incorporated area of the municipality. ]  Notwithstanding any contrary provision of law, general or special, the governing body of a locality  [ , or any city entirely encompassed therein, ] shall have jurisdiction over any advertising structure or any sign, as defined in § 33.1-351, located on the campus of a public institution of higher education within such locality if such advertising structure or any part of the advertising or informative contents of such sign is visible from a point outside such campus.  [ The jurisdiction over advertising structures and signs granted herein shall not apply to public institutions of higher education that have entered into a management agreement, as defined in § 23-38.89, on or before January 1, 2007. ]
