071594812Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 36-99.3:01 as follows:
§ 36-99.3:01. Carbon monoxide detectors in colleges and universities and assisted living facilities.
A. Carbon monoxide detectors shall be installed in any (i) building that is used, in whole or in part, as a dormitory to house students by any public or private institution of higher education, or (ii) assisted living facility licensed by the Department of Social Services, regardless of when the building or facility was constructed, when such building or facility contains dwelling units or living space that have an attached garage or carport, are adjacent to a parking space, or contain or are serviced by an appliance or device that uses carbon-based fuels, in accordance with the provisions of the Uniform Statewide Building Code by July 1, 2010.
B. The Board of Housing and Community Development shall promulgate regulations by December 1, 2008, as part of the Building Code requiring the installation of carbon monoxide detectors in new buildings that are used, in whole or in part, as a dormitory to house students by any public or private institution of higher education and assisted living facilities licensed by the Department of Social Services when such building or structures contain dwelling units or living space that have an attached garage or carport, are adjacent to a parking space, or contain or are serviced by an appliance or device that uses carbon-based fuels.
2. That the Board of Housing and Community Development and the Fire Services Board shall establish a working group consisting of (i) the State Fire Marshal, (ii) representatives of local fire departments and rescue squads, and (iii) representatives of landlord and tenant interests to develop a public education program focusing on the dangers of carbon monoxide poisoning and preventive measures that may be taken to alleviate such dangers. The Boards shall report the educational program to the Governor and the 2008 Session of the General Assembly.
