SUMMARY AS PASSED SENATE:

Identity theft; penalties.  Imposes a Class 6 felony for an identity theft violation if five or more persons' identifying information was obtained in the same transaction or occurrence and a Class 5 felony where 50 or more persons' identifying information was obtained in the same transaction or occurrence. The bill does not change provisions of current law that punish identity theft as a Class 1 misdemeanor unless there is a financial loss greater than $200, in which case the penalty is a Class 6 felony.

SUMMARY AS INTRODUCED:

Identity theft; penalties.  Increases the penalty for an identity theft violation from a Class 1 misdemeanor to Class 6 felony. Under current law there must be a financial loss greater than $200 in order for an initial violation to be a felony.  The bill increases any second violation from a Class 6 felony to a Class 5 felony. The bill also increases any violation resulting in the arrest and detention of the person whose identification documents or identifying information were used to avoid summons, arrest, prosecution, or to impede a criminal investigation from a Class 6 felony to a Class 5 felony.
