SUMMARY AS PASSED HOUSE:
Criminal cases; mental health reports. Provides that in any felony criminal case where the defendant's sanity is in issue and defendant obtains his own expert to evaluate him, the expert shall prepare a full report and shall provide it to the attorney for the Commonwealth.
SUMMARY AS INTRODUCED:
Criminal cases; mental health reports. Provides that in any criminal case where the defendant intends to make his mental health status an issue in the guilt or sentencing phase of a criminal trial, the defendant or his attorney must give the Commonwealth, at least 21 days prior to trial, a written summary of any expert testimony that the defendant intends to use as evidence at trial. The summary shall describe the witness's opinion, the bases and reasons for the opinion, and the witness's qualifications.
