050274396Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding in Chapter 15 of Title 2.2 a section numbered 2.2-1515 as follows:
§ 2.2-1515. Continuing appropriations upon failure to enact a biennial budget.
The provisions of this section shall be applicable in the event that (i) the General Assembly fails to appropriate funds for the operations of government for the ensuing biennium during a regular or special session in any even-numbered year before May 1 of such year or (ii) the Governor vetoes such general appropriation act and the General Assembly fails to override the Governor's veto before May 1 of such year.
In either such event, the biennial appropriation act in effect on the first day of the regular session held in the even-numbered year shall continue in effect for the next fiscal year beginning July 1 of that even-numbered year and, if not superseded by law, for the following year.
Any increase or decrease in revenues to fund appropriations for the continuing fiscal year shall be allocated to appropriation items proportionally.
