048159724Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 46.2-881.1 as follows:
§ 46.2-881.1. [ Speed limit within 500 feet of yard sale, auction, or other
special event to which the public is invited.
Any person promoting or hosting a yard sale, auction, or other special event to
which the public is invited shall, before the commencement of the event, place
signs reading: "CONGESTED AREA AHEAD." Such signs shall be placed at every location where any public
highway crosses an imaginary circle whose radius is 500 feet and whose center is the center of the
yard sale, auction, or other special event. Such signs shall be neon green in
color. Within the imaginary circle at the perimeter of which these signs have
been placed, the maximum speed limit shall be 25 miles per hour. No signs
beyond those required by this section shall be required for the enforcement of
this speed limit.
Failure to post signs as required by this section shall constitute a Class 4
misdemeanor.
For the purpose of this section "yard sale" means an occasional sale of
household goods at the residence of their owner, and shall include any similar
event, whether or not it is specifically denominated a "yard sale."
The provisions of this section shall not apply where the posted speed limit is
25 miles per hour or less nor shall they apply where the event is being held in a
commercial establishment or elsewhere where there is suitable parking space.
Placement of certain signs.
The governing body of any county, city, or town may, by ordinance require any person hosting any yard sale, auction, or other special event that is open to the public, held out-of-doors, and is within 100 feet of any public highway on which the posted speed limit is 35 miles per hour or more to notify the local governing body of such event. The local governing body may place or cause to be placed a temporary sign or signs 50 feet from the location of the event in both directions. Every such sign shall state: Caution--Congested Area Ahead. ]
