016039896WHEREAS, the Commonwealth's localities face many challenges in areas related to local economic development, growth, infrastructure, and quality of life issues; and
WHEREAS, localities rely on the use of zoning ordinances to address many of these issues; and
WHEREAS, because Virginia is a Dillon Rule state, localities in Virginia have only those zoning powers that the Commonwealth delegates to them; and
WHEREAS, localities frequently represent to the General Assembly that current zoning enabling legislation is inadequate to address today's challenges; now, therefore, be it
RESOLVED by the House of Delegates, the Senate concurring, That the Joint Legislative Audit and Review Commission, with the cooperation and assistance of the Commission on Local Government and localities of the Commonwealth, be directed to study whether the zoning enabling laws of the Commonwealth provide adequate zoning powers to address local economic development, growth, infrastructure, and quality of life issues.
All agencies of the Commonwealth shall provide assistance to the Commission for this study, upon request.
The Commission shall complete its work in time to submit its findings and recommendations to the Governor and the 2002 Session of the General Assembly as provided in the procedures of the Division of Legislative Automated Systems for the processing of legislative documents.
