019131956Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 10.1-204.1 and in Article 10 of Chapter 6 of Title 46.2 a section numbered 46.2-749.49 as follows:
§ 10.1-204.1. Department of Conservation and Recreation Greenways and Blueways Fund established; purpose.
There is hereby established a special nonreverting fund in the state treasury to be known as the Department of Conservation and Recreation Greenways [ and Blueways ] Fund, hereafter referred to as the Fund, to be used by the Department of Conservation and Recreation to acquire, construct, operate, maintain, and promote a statewide system of trails, including greenways and blueways. The Fund shall be a nonlapsing fund, comprised of moneys received from the sale of special license plates issued pursuant to § 46.2-749.49. The Fund shall be established on the books of the State Comptroller and the moneys shall be paid into the state treasury and credited to the Fund. Interest earned on moneys in the Fund shall remain in the Fund and be credited to it. Any moneys remaining in the Fund, including interest thereon, at the end of each fiscal year shall not revert to the general fund but shall remain in the Fund. Expenditures and disbursements from the Fund shall be authorized by the Director of the Department of Conservation and Recreation.
§ 46.2-749.49. Special license plates for supporters of greenways and blueways; fees.
A. On receipt of an application and payment of the fee prescribed by this section, the Commissioner shall issue special license plates bearing the legend "Outdoor Adventures" to supporters of a statewide system of trails, including greenways and blueways.
B. The annual fee for plates issued pursuant to this section shall be twenty-five dollars in addition to the prescribed fee for state license plates. For each such twenty-five-dollar fee collected in excess of 1,000 registrations pursuant to this section, fifteen dollars shall be paid into the state treasury and credited to the special nonreverting fund known as the Department of Conservation and Recreation Greenways and Blueways Fund established under § 10.1-204.1.
