SUMMARY AS PASSED HOUSE:
Assault upon a child; homicide of a child; penalty. Provides that the voluntary manslaughter of a child under the age of five is punishable as a Class 4 felony. (Currently, all voluntary manslaughter is punishable as a Class 5 felony.)
SUMMARY AS INTRODUCED:
Assault upon a child; homicide of a child; penalty. Provides that the voluntary manslaughter of a child under the age of five is punishable as a Class 4 felony. (Currently, all voluntary manslaughter is punishable as a Class 5 felony.) The bill also provides that any person over the age of 14 who commits an assault and battery against a person under the age of five which results in severe bodily injury or permanent and significant physical impairment is guilty of a Class 5 felony.
