SUMMARY AS PASSED:
Unlawful electronic file or mail. Includes an obscene item stored in an electronic medium as one of the enumerated obscene items under § 18.2-373. The bill provides that an Internet service provider (ISP) or electronic mail service provider shall not be liable under § 18.2-391 when a person using such services commits prohibited acts regarding the provision of sexually explicit material to juveniles.
SUMMARY AS PASSED HOUSE:
Unlawful electronic file or mail. Includes an obscene item stored in an electronic medium as one of the enumerated obscene items under § 18.2-373. The bill provides that an Internet service provider (ISP) or an employer shall not be liable under §§ 18.2-374 or 18.2-391 when another person or an employee violates those sections and provides exceptions where an ISP or an employer may be liable. The bill also removes the provisions regarding electronic file or message in § 18.2-391.
SUMMARY AS INTRODUCED:
Unlawful electronic file or mail. Provides that, if a person uses the services of an Internet service provider or an electronic mail service provider in violating subsection A of § 18.2-391, such Internet service provider or electronic mail service provider shall not be held responsible for the violations.
