LD2765112WHEREAS, one of the most important functions of the Commonwealth is to provide for the safety of its citizens; and
WHEREAS, the Commonwealth has made great strides in reducing the incidence of drunk driving and educating the public on the tragic consequences of drinking and driving; and
WHEREAS, although the number of incidents and fatalities resulting from individuals driving while under the influence of alcohol has declined sharply over the past few years as increasing numbers of citizens have become involved in efforts to keep drunk drivers off the highways, there is much more that can be done to reduce the number of injuries and fatalities driving under the influence causes every year; and
WHEREAS, approximately 40 percent of all driver's license suspensions resulting from DUI convictions do not result in a reinstatement of their driver's license; and
WHEREAS, there is concern that these individuals are driving without a valid drivers' license; and
WHEREAS, these individuals are not only breaking the law and driving without automobile insurance but are also posing an increased risk to the public; and
WHEREAS, this issue needs to be examined to determine why such a large percentage of these drivers never have their driver's license reinstated and if they are imposing an unnecessary danger to the public; now, therefore, be it
RESOLVED by the House of Delegates, the Senate concurring, That the Department of Motor Vehicles shall study why approximately 40 percent of all driver's license suspensions resulting from DUI convictions do not result in a reinstatement of the driver's license and therefore the license reinstatement fee is not paid. The Department shall complete its work in time to submit its report and recommendations to the Governor and the 1995 Session of the General Assembly, in accordance with the procedures of the Division of Legislative Automated Systems for the processing of legislative documents.
