Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 10.1-1402.05 as follows:

§ 10.1-1402.05. Coal ash landfill storage; permit requirements; proximity to private wells.

No (i) application for a new coal ash landfill storage facility permit or (ii) application for a permit amendment or variance for such facility shall be approved if the facility is located within one mile upgradient of any existing private well.
