Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 36-99.10:2 as follows:

§ 36-99.10:2. Electric vehicle charging infrastructure standards for certain multifamily residential housing construction projects.

The Board shall promulgate regulations to establish, in accordance with the Administrative Process Act (§ 2.2-4000 et seq.), electric vehicle charging infrastructure standards for multifamily residential housing construction projects consisting of more than 25 residential dwelling units. During the design and construction process, a developer shall ensure that at least 25 percent of the available parking spaces are electric vehicle charging ready by providing electrical room or breaker boxes designed to accommodate the electrical equipment and distribution wiring to support, at a minimum, Level 2 chargers as defined by the U.S. Department of Energy. Landlords, condominium unit owners' associations, and property owners' associations shall be authorized to negotiate and contract with electric vehicle charging providers with respect to the installation and maintenance of electric vehicle infrastructure and any related revenue sharing. The regulations shall only apply to any new multifamily residential housing construction projects approved by a locality after January 1, 2024. As used in this section, "multifamily residential housing" includes structures that are comprised of apartments, as defined in § 55.1-2000; condominiums, as defined in § 55.1-1900; and attached townhomes.

2. That the Board of Housing and Community Development shall promulgate the regulations required by § 36-99.10:2 of the Code of Virginia, as created by this act, by January 1, 2024.
