20102016DBe it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 40.1-51.9:3 as follows:
§ 40.1-51.9:3. Certification of onsite superintendents.
A. As used in this section, unless the context requires a different meaning:
"Multifamily dwelling unit" means the same as that term is defined in § 55.1-1200.
"Onsite superintendent" means the individual responsible for performing repairs and providing maintenance for a multifamily dwelling unit.
B. Any onsite superintendent responsible for maintaining safe boiler, unfired pressure vessel, and water heater operations in a multifamily dwelling unit shall be certified as an inspector by the Board pursuant to § 40.1-51.9:1. Onsite superintendents certified in the maintenance of safe boiler, unfired pressure vessel, and water heater operations shall not be required to hold any other professional or occupational license or certification; however, nothing in this subsection shall prohibit an individual from holding more than one professional or occupational license or certification.
C. Any onsite superintendent seeking certification as provided in this section shall file an application pursuant to § 40.1-51.9:1 that shall be accompanied by a fee set by the Board pursuant to § 40.1-51.15.
D. Nothing in this chapter shall be construed to prevent a person who is not certified pursuant to § 40.1-51.9:1 from performing maintenance or other repairs that are not related to boilers, unfired pressure vessels, or water heater operations.
