SENATE BILL NO. 1199 FLOOR AMENDMENT IN THE NATURE OF A SUBSTITUTE (Proposed by Senator Stuart on January 22, 2021) (Patron Prior to Substitute--Senator Petersen) A BILL to amend the Code of Virginia by adding in Chapter 10.1 of Title 10.1 a section numbered 10.1-1016.1 and by adding in Chapter 17 of Title 10.1 a section numbered 10.1-1705.1, relating to conservation easements; construction.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding in Chapter 10.1 of Title 10.1 a section numbered 10.1-1016.1 and by adding in Chapter 17 of Title 10.1 a section numbered 10.1-1705.1 as follows:

§ 10.1-1016.1. Construction.

Notwithstanding any provision of law to the contrary, any easement created on or after July 1, 2021, and held pursuant to this chapter shall be construed in favor of achieving the conservation purposes for which it was created and shall include provisions notifying the grantor of such construction.
