A BILL to amend and reenact § 46.2-749.6 of the Code of Virginia and to repeal § 2 of the first enactment and the second and third enactments of Chapter 737 of the Acts of Assembly of 2018, relating to the special license plates bearing the legend STOP GUN VIOLENCE and the special license plate for supporters of the National Rifle Association; revenue-sharing provisions.

Be it enacted by the General Assembly of Virginia:

1. That § 46.2-749.6 of the Code of Virginia is amended and reenacted as follows:

§ 46.2-749.6. Special license plates for supporters of the National Rifle Association.

A. On receipt of an application therefor and payment of the fee prescribed by this section, the Commissioner shall issue special license plates to supporters of the National Rifle Association.

B. The annual fee for plates issued pursuant to this section shall be $25 in addition to the prescribed fee for state license plates. For each such $25 fee collected in excess of 1,000 registrations pursuant to this section, $15 shall be paid into the state treasury and credited to a special nonreverting fund known as the National Rifle Association Fund established within the Department of Accounts. These funds shall be paid annually to the Behavioral Health and Developmental Services Fund and used to enhance and ensure for the coming years the quality of care and treatment provided to individuals receiving public mental health, developmental, and substance abuse services in Virginia. All other fees imposed under the provisions of this section shall be paid to, and received by, the Commissioner of the Department of Motor Vehicles and paid by him into the state treasury and set aside as a special fund to be used to meet the necessary expenses incurred by the Department of Motor Vehicles.

2. That § 2 of the first enactment and the second and third enactments of Chapter 737 of the Acts of Assembly of 2018 are repealed.
