SUMMARY AS PASSED HOUSE:

Financial institutions; reporting by financial institution staff; supporting information and records. Provides that any financial institution staff who suspects that an adult has been financially exploited may provide supporting information and records to the local department of social services or the adult protective services hotline, in addition to reporting such suspected exploitation to such local department or such hotline provided for under current law.

SUMMARY AS INTRODUCED:

Financial institutions; immunity for disclosures of financial exploitation. Provides an individual employed by a covered financial institution with immunity from civil or administrative liability for disclosing, in good faith and with reasonable care, the suspected exploitation of an adult age 60 or older or a disabled adult to the state Department of Social Services, any local department of social services, a law-enforcement agency, or certain federal agencies. In order to acquire such immunity, the individual is required to have served at the time of the disclosure as a supervisor or compliance officer and to have received training that, among other things, instructs individuals on how to identify and report the suspected exploitation of an adult, including common signs that indicate the financial exploitation of an adult. The measure includes similar immunity provisions for covered financial institutions.
