17104358DBe it enacted by the General Assembly of Virginia:
1. § 1. That the Department of Environmental Quality (DEQ) shall identify the owner of any combined sewer overflow (CSO) outfall that discharges into the Potomac River Watershed.
§ 2. That in order to comply with federal and state water quality requirements, DEQ shall require such owner, by December 31, 2020, or sooner if practicable, to (i) determine what actions by the owner are necessary to bring the CSO outfall into compliance with the Presumption Approach described in the CSO Control Policy adopted by the U.S. Environmental Protection Agency at 59 C.F.R. 18688 and (ii) submit a schedule for taking such actions to DEQ for approval.
§ 3. That any owner of a CSO outfall that discharges into the Potomac River Watershed shall implement the schedule approved by DEQ pursuant to § 2 by July 1, 2030, or sooner if practicable.
§ 4. That DEQ shall determine, for any owner with more than one CSO outfall that discharges into the Potomac River watershed, the order in which the outfalls are to be addressed.
§ 5. That DEQ shall incorporate any such actions it takes with respect to a CSO outfall that discharges into the Potomac River watershed into any future permit issued to the owner by DEQ or the State Water Control Board.
